Hi
 
Is it possible to make the default setting for the newsletter option in the users profile be set to yes rather than no as most new user miss it and then complan about not getting the newsletters.

Members need to select to opt themselves in, automatically opting people in to reciving newsletters would be in breach of spam laws in most countries.

Thanks Bruce.

What if the registration text made it clear it is turned on by default and they turn it off if they wish. By registering then they are agreeing to the terms.

Sorry not a solicitor. You would need to check on your own states laws in this regards as to whether it would be allowed.

I am uk Bruce and have checked the law just now
 
Provided a clear message is given to the user what they are agreeing to and they have to manually accept to continue then that is classed as an "opt in" in the same way that clicking a subscribe option is for the news letter. It cannot be auto without any form of opt in by the user.

Provided the terms for membership "clearly" state they are opting in to a newsletter as part of joining and they accept it we are fine. They must have the option to opt out.  not intending to do away with that.
 
In that light any help in the method ? By support ticket if you want to be off the forum.

Do not know wher you found that by my understanding of the 2003 communications act is that you are not allowed to opt in users and they have to check the box themselves.

I sent the commission bods an email and they sent me a reply and the doc that lays it out.
They have to check a box to show an opt in but it can be a general opt in for multiple features provided it states what they are and they have an option to turn it off again.
 
The terms and conditions button provided it clearly states it includes a newsletter as part of the terms and how to turn it off is classed as an opt in.
if the emails are in relation to the business in which they signed up then you don't even need an opt in as it is not classed as unsolicited. As in if you buy a parcel from amazon they can send you a despatch email or an optional add on offer without any opt ins as it is in relation to your purchase.

It's not as black and white as people think it is. I can post the sections that lay it out if you like.

The way it presently is with customers opting themselves in is the best way to comply with spam laws and the anti spam policies of web hosts both in the UK and overseas.

Berrying away the automatic opt-in permission with in the terms and conditions which are probably not read may get you around the law but I suspect you will quickly find that you get your domain blacklisted for spamming by anti-spam organisations and break terms of your hosting contract.
