Quick question - how would I make it so new people who register to my forum, have 'yes' checked as default for the question about signing up for the Newsletter?

It is not set as an option by default as this would be illegal in the EU and many other countries as you can not opt someone in, they have to opt themselves in to receiving such communication and not have to uncheck the option.

Unless you interpret the act of signing up for the forums as opting in. But the EU may or may not interpret it that way. Better to err on the safe side.
Plus, I think most users find it annoying that they have to uncheck such boxes. It feels sleazy and sneaky and unethical. Then add the fact that most of those people who did not check the box probably are not expecting your newsletter, so when it comes they either click spam or delete it, thereby wasting bandwidth and the members time.
It's best, for many reasons, to have people specifically say they want it. A lower amount of quality readers is better than a high quantity of readers that never read it anyway.
