in a sql query in access you can use the Now() function in the query but in sql server I get

'Now' is not a recognized function name.

so what function do I use? not GetDate, this is looking for date and time right. please advise. thanks in advance.

in SQL you  have to use GetDate()

Also True is 1 and False is 0
