Anything you do is automatically copyrighted the moment you do it. However, in order to prove it in a court, you may want to send it to yourself by registered mail and not open the mail when you receive it.

Patents and registered trademarks are different.

why prove it with a mail?

isnt it good enough to write it on the site and have a copy myself?

Nope. That won't hold up in a court. You need to be able to prove the date. Registered mail provides you with a legal verification of the date. It is also a cheaper way than going to a lawyer's office and paying them a whack-load of money to perform some unnecessary legal hocus-pocus.

Completely agreed... There are other much better and less ethical ways to deal with people who steal your content

There is a cheap alternate way to copyright something, which is ok in court, if you send the material by registered post to yourself, and dont open it, then if ownership comes up you can open it in court and win

if it's on file on your computer, why can't you just save a copy to disk, and they can read the "last modified" date?

Posted By: Bluefrog
Date Posted: 01 January 2004 at 12:16pm

That would work. Just burn it to CD. I'd include a print version as well though just in case.

Registered mail need to be signed for. It is also a bit more expensive.

Ooops. KC's and my posts were to close together timewise.

The last modified date means nothing because it is easily changed.

e.g. Change the date on your computer either in Windows or during the bootup setup and put it back a few years. Open the file, make a small change then delete the change. Save the file. Check the "Last modified" date.

just print the code, go to your bank and have it notarized for free. No big deal.

This wouldn't work as there are programs that will modify file dates

Also if you change the system date on your computer and reopen or recompile one of the files, the new date would appear as  Last modified.

its possible to edit the last edited date on the files then burn them to cd.. or set the computer date to 2000 and burn.. so i dont think that would be better than just store the files on hd..

In the US, the poor man's copyright (i.e. mail it to yourself) does not hold up in court (even registered mail). If something is important enough to you to copyright beyond just adding the copyright info to it, then you should file the correct copyright forms and pay the fee. You can file yourself with no cost above the registration fee.

Has there been any case law to back it up?
It seems that it would defeat the point of charging for copyright registration if it could be easily circumvented. Mail even registered mail is easily opened and resealed by simple steaming, it's not a fool proof method of establishing a date of creation.

AFAIK in the UK, you can go to your solicitor (lawyer) and get the code stamped by him and the "original" kept in thier office. That way if it ever goes to court, the solicitor will have proof of when it was stamped. I am not sure what they charge but I have heard it is not a lot, in the overall scheme of things.

To be honest, I really find this whole thing quite stupid - I don't mean our discussion here - I mean the fact that you actually have to go out and do things like this to protect yourself against some lame-@$$ who is too lazy to do the work itself (no human dignity assigned by ommission of "him/her").

I didn't know the registered mail thing doesn't hold up anymore in the US.

I hope Bruce archives the DB/forum or passes it on if he does another major upgrade like he did with 6~7, because there is a lot of really good information above, and in other posts as well of course. [ hint hint  ]
