Just ask them to give you an uptime report, if you feel they are faking it you can sue them.

isn't it possible to check when the server were shut down and when it were started? then you could calculate the time it was down and find out how many percent it is..

only a suggestion, maybe it's not possible

Well if the host gives you access to the shutdown logs (win2003) which I kinda doubt. Just write a little .net Socket app, leave it running on your computer and count the clicks you could connect.
